Street-wise Challenge Contest
The “Street-Wise Challenge” contest (“Contest”) is
sponsored by Happy House, a California nonprofit public benefit corporation,
which is located at, 9420 Reseda Blvd, #572 Northridge, CA 91324 818-882-7483
(“Happy House”) All inquiries should be directed to Street-Wise
Challenge Contest at the above address. Happy House is a California non-profit
corporation.
Purpose of the Contest
The purpose of the Contest will be to reward and acknowledge groups who perform
a community service project that most improves their community and the lives
of its residents (“Community Service Project”).
Eligibility
The Contest is open to all groups whose participating members are 13 years
of age or older at the time the Contest commences (“Participating Group(s)”).
All Participating Groups must obtain and submit to Happy House the appropriate
signed release form, attached as Exhibit A for minors and Exhibit B for participants
18 years of age or older, from each of their members before starting their Community
Service Project.
The Contest is subject to all federal, state and local laws and regulations
and, if prohibited by law in any jurisdiction, is not available to participants
in that area.
Employees of Happy House and its affiliated companies, the judges and their
immediate family members and members of the same households, whether related
or not, are not eligible to participate in the Contest. The Contest is for United
States residents only.
Good Works Made Known
We want the world to know what groups like yours are doing to improve the
lives of those around us. While it is not required to be eligible to win, each
Participating Group has the option of submitting a video of their Community
Service Project (“Video(s)”) or they can submit still photographs
(“Photograph(s)” showing the beginning through the completion of
their Community Service Project.
If you elect to make a Video of your Community Service Project, don’t
worry about editing it or if it looks like another home movie. If you don’t
have access to a video camera, let us know and we will try to arrange for the
loan of a video camera to your Participating Group. If you are not familiar
with using video cameras, there are certain skills you will have to learn to
use the camera, but this is not difficult. When we have our pool of Participating
Groups in place we are going to have a fun day of orientation on the Contest
and the use of the video camera.
You don’t have to edit your Video but simply record the process of doing
your Community Service Project and turn in at least an hour of video.
Documentary Film
Happy House intends to create a documentary film (“Documentary”)
to illustrate how groups can improve their community. Happy House will take
the Videos submitted and the still photos submitted by the Participating Groups
and may use these in the Documentary. Each of the Participating Groups and their
participants will give Happy House the rights to their Videos and Photographs
as defined further below.
How To Enter The Contest
Visit www.happpyhouse.org to find instructions on how to enter the contest.
Happy House, in its sole discretion, may post the names of the Participating
Groups and their ideas for Community Service Projects to www.happyhouse.org.
All Videos and Photographs submitted must not contain any of the following:
- Brand names, trademarks and any copyrighted material not in the public
domain or for which you have not obtained the rights, in writing, to use;
- Voice-overs not done by Participating Group members;
- Photography or artwork not created by Participating Group Members while
doing their Community Service Project;
- Any content that would not be suitable for viewing by all audiences and
be a positive viewing experience such as nudity, lewd or vulgar behavior;
offensive language and/or gestures;
- Images and/or comments from people who have not given their permission to
appear in the Video or Photograph for the purpose of entering this Contest
and being used as detailed herein by Happy House.
Any Video or Photograph that Happy House, in its sole discretion, determines
violates the above rules will not be eligible.
Participating Groups represent and warrant that (i) the projects they propose
and the Videos that they submit are their own original creations and do not
infringe on any other person's or entity's rights; (ii) they have obtained permission,
if applicable, from the people featured in the Video and/or Photograph to enter
the Video and/or Photographs in this Contest with the understanding that some
parts of the Video and/or the Photographs may be used in the Documentary; and
(iii) the submission of the Video and/or the Photographs will not violate any
agreements or understandings the Participating Group has with any third party.
Each Participating Group can submit only one Video and/or Photographs of one
Community Service Project. Videos must be made in English or subtitled in English.
Each Video and/or Photograph submission must be accompanied by an email address,
mailing address and phone number of a contact person and a statement that the
Participating Group has obtained signed releases from each of its participating
members and that it has complied with all the rules of the Contest.
All Participating Groups grant to Happy House the right to contact you regarding
your entry, publicize your entry, promote your entry for any other purpose related
to the Contest and/or broadcast your entry.
Grant of Rights in Videos and/or Photographs Submitted
Except where prohibited by law, participation in the Contest:
- Constitutes a Participating Group and its members consent to Happy House's
use of their/its/his/her name, likeness, voice, opinions;
- Assigns to Happy House all rights to use, copy, sublicense, edit, modify,
make derivative works, publish, exploit, transmit, distribute, publicly perform,
publish, delete or display the content of and elements embodied in the submitted
Video and/or Photographs, in whole or in part, in perpetuity in any and all
media (whether now existing or hereafter devised) without limitation, and
without additional consideration, payment or acknowledgment to the entrant;
- The unconditional right to use the idea and statements about the Community
Service Project, the Video and/or Photographs for advertising/publicity purposes
without additional compensation, except where prohibited by law.
Requirement to Supervise
While doing their Community Service Project, all Participating Groups agree:
- At all times, to have adults present to supervise the activities of any
minor members of the group while doing a Community Service Project;
- To only undertake any activity relating to the Community Service Project
when there are no risks to any of the members of the group;
- To not trespass on the private property of anyone;
- To obtain permission, if necessary, from any applicable authority or body,
before commencing their Community Service Project;
- To provide safe transportation, if needed, for all members to and from the
location of the Community Service Project;
- To obtain permission, written if possible, from each and every person appearing
in a Photograph or Video for their image and/or comments to be entered into
this Contest and for it to be used by Happy House as set forth herein. If
the person appearing in the Photograph or Video is a minor then to obtain
the permission from the minor’s parent or legal guardian. If the Video
or Photograph is of a crowd shot containing a number of people without focusing
on any one person, then no permission is required; (A copy of the written
release to be obtained where possible is attached as Exhibit C.)
- To explain these Official Rules to its members, their parent or legal guardian
if the member is a minor under age 18.
- To ensure that all of the Participating Group’s members, or their
parent or legal guardian, have signed the AUTHORIZATION AND RELEASE FOR PHOTOGRAPHS
AND/OR AUDIO AND/OR VIDEO RECORDING AND RELEASE OF LIABILITY.
Cost
There is no payment to Happy House or anyone else that is required in order
to participate in the Contest. Each Participating Group may incur costs while
performing their Community Service Project but these costs are sole responsibility
of the Participating Group.
Judges
The names of the judges for the Contest (“Judges”) will be posted
on the Happy House website at www.happyhouse.org
prior to the end of the Contest.
Criteria
The Judges will select the Community Service Projects and Videos that they
determine will best represent the purpose of the Contest.
Dates
Announcement of winners will be made on (date yet to be decided for next Challenge) at www.happyhouse.org.
In the event that an extraordinary number of submissions are received, the date
for announcement of the winners may be extended. Any changes to the announcement
date will be posted at www.happyhouse.org.
Project Prizes
All Participating Groups submitting a Community Service Project will receive
a recognition certificate and be entered into the competition to receive the
Street-Wise Challenge Awards. The Community Service Project prizes are:
- 1st Place: $1,000
- 2nd Place: 500.00
- 3rd Place: 250.00
Special Accomplishment Awards
Each Participating Group awarded a Street-Wise Challenge Award may nominate
one individual who contributed most to the successful completion of their Community
Service Project. The Judges will choose three of the nominated individuals who
will receive a tour of an animation studio conducted by Nancy Cartwright. In
addition, each of the three nominated individuals will be honored with special
recognition awards.
Video Prizes
The Judges will also recognize excellence in the Videos submitted. The Video
winners will be chosen for their quality, as determined in the sole and absolute
discretion of the Judges. Video prizes are:
- 1st Place: $1,000
- 2nd Place:$ 500.00
- 3rd Place:$ 250.00
Notification; Provision of Phone Number, Address
Winners will be notified via email and their names will be posted at www.happyhouse.org.
If a winning Participating Group does not respond to Happy House within ten
(10) business days of the first attempt to notify them, their prizes are forfeited
and will be awarded to the next highest ranking Participating Group.
Delivery of Prizes
All cash prizes are to be delivered at an Awards Party. Prizes not claimed
at the Awards Party will be sent by mail to the addresses provided by the Participating
Group. Happy House shall not be responsible for the failed delivery of any documents
and/or prizes provided that Happy House addresses the documents and/or prizes
to the address provided by the winner.
Announcement of Winners
Happy House will announce the winners and post their full names and city and
state of residence at www.happyhouse.org.
Use of Winners’ Names and Likeness
Each Participating Group winner who accepts any prize will be deemed thereby
to have granted to Happy House the right, at any time and from time to time,
to print, publish, broadcast and use, worldwide and in any media now known or
hereafter developed, including but not limited to, the Internet and world wide
web, the name, portrait, picture, voice, likeness and biographical information
of each such winner as news or information and for advertising and promotional
purposes without additional consideration, except where prohibited by law.
Severability
If any one or more provisions of these Official Rules are held to be invalid,
illegal or unenforceable by a court of competent jurisdiction, such invalidity,
illegality or unenforceability shall not affect the validity, effect or enforcement
of any other provision or provisions of these Official Rules.
Binding Arbitration, Venue, Choice of Law
By participating in the Contest, each Participating Group and its members agree:
- Any and all disputes, claims, and causes of action arising out of or in
connection with this Contest, or any prizes awarded, shall be resolved individually,
without resort to any form of class action;
- The parties will first try in good faith to settle the dispute by mediation
under the Commercial Mediation Rules of the American Arbitration Association,
before resorting to arbitration;
- Any remaining unresolved controversy or claim arising out of or relating
to this Contest, or the breach thereof, shall be settled by binding arbitration
in accordance with the Commercial Arbitration Rules of the American Arbitration
Association, and judgment upon the award rendered by the arbitrator(s) may
be entered in any court having jurisdiction thereof;
- All mediations and arbitrations shall be held in Los Angeles County, California;
- Any and all claims, judgments, and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering this Sweepstakes,
but in no event attorneys' fees;
- Under no circumstances will a Participating Group or its Members be permitted
to obtain awards for, and entrant hereby waives all rights to claim, punitive,
incidental, and consequential damages, and any other damages, other than for
actual out-of-pocket expenses, and any and all rights to have damages multiplied
or otherwise increased;
- All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations
of a Participating Group or its members, shall be governed by, and construed
in accordance with the laws of the State of California, without giving effect
to any choice of law or conflict of law rules or provisions (whether of the
State of California or any other jurisdiction), that would cause the application
of the laws of any jurisdiction other than the State of California.
Release
By participating in the Contest, each Participating Group and its members
agree to release and hold harmless Happy House, its officers, directors, employees
and agents (the "Released Parties") from and against any claim or
cause of action arising out of their participation, including but not limited
to their performance of any activity in connection with their Community Service
Project, or in the Contest or receipt or use of any prize. The Released Parties
are released of any liability for any damage, destruction, wreckage, breakage,
impairment or potential damage to any materials, software or systems used in
connection with the Contest. The Released Parties are not responsible for late,
lost, misdirected, altered or damaged entries.
Limitations of Liability: The Released Parties are not responsible
for any incorrect or inaccurate information, whether caused by Contestants,
printing errors or by any of the equipment or programming associated with or
utilized in the Contest or by any technical or human error which may occur in
the processing of submissions in the Contest. The Released Parties are not responsible
for any error, omission, interruption, deletion, defect, delay in operation
or transmission, communications line failure, theft or destruction or unauthorized
access to, or alteration of, entries. The Released Parties are not responsible
for any problems or technical malfunction of any telephone network or lines,
computer on-line-systems, servers or providers, computer equipment, software
or failure of email on account of technical problems or traffic congestion on
the Internet or at any web site or combination thereof, including injury or
damage to Contestant's or to any other person's computer related to or resulting
from participating in the Contest.
DISCLAIMER: Happy House is an independent associate of The Way to Happiness
Foundation International. The views and opinions expressed by Happy House are
not necessarily the views of The Way to Happiness Foundation International.
Happy House is responsible for the content herein, including the truth and legality
of the statements made, and Happy House represents that it has the legal right
and authority to provide the content or graphics provided. The Way to Happiness
Foundation International does not independently investigate the content Happy
House places on its webpage(s) or any other promotional materials, and The Way
to Happiness Foundation expressly disclaims liability for same.
By participating in the Contest, Participating Groups agree that they understand
and agree to abide by all the terms of these Official Rules and by the decisions
of Happy House which are final and binding on all matters pertaining to this
Contest. Participating Groups further agree to have each participating member
of their group who participates in the Community Service Project to complete
the applicable release attached hereto prior to the Participating Group starting
any work on the Community Service Project.

The STREET-WISE Challenge (“Contest”) is a contest sponsored by

dedicated to building stronger families and happier communities. The Contest
provides cash prizes and awards for participating groups who complete a simple
family or community-based project that helps to make life better for residents
of our vibrant neighborhoods.
I, , am the parent or legal guardian of ________________, a minor, who plans
to participate in the Contest as a member of ____________ (“Participating
Group”).
I hereby acknowledge that during the Contest, videos, recordings and photographs
(“Media”), whether made by or on behalf of Happy House or by others,
may capture my child’s name, voice, or likeness. Such Media may be used
for non-commercial research, exhibition, publicity and other uses by Happy House
(the “Purposes”). I also understand that the Media may be copied,
copyrighted, edited and distributed by Happy House.
In exchange for allowing my child to participate in the Contest through the
Participating Group, I hereby grant to Happy House, its assigns and representatives
the irrevocable, unrestricted, non-exclusive, royalty-free worldwide right to
use, display and/or broadcast the Media and name of my child in any media for
perpetuity, and to alter the same without restriction for the Purposes described
above. I waive any right that I may have to review or approve of the finished
product, or the use to which it may be applied. I release and discharge Happy
House and its employees from any liability to me by virtue of any representation
that may occur in the making or editing of the Media.
I understand that neither my child nor I will receive any compensation for
the any use by Happy House of the Media.
I understand that Happy House may also contact my child after the Contest and
ask for comments on the Contest, and that my child’s comments are subject
to the terms of this release. Both my child’s participation in the Contest
and in answering questions during or after the Contest is voluntary.
I understand that Happy House is not obligated to use any Media and the decision
to use a particular form of the Media is at Happy House’s sole discretion.
While care will be taken to maintain the intent and purpose of the Media, editing
may be necessary if in Happy House’s sole discretion the editing will
better accomplish the Purposes and I acknowledge that Happy House has the right
to make such edits and neither my child nor I have any right to approve any
editing done by Happy House.
I also represent that my child is assisting the Participating Group perform
a community service project and make the required video. My child and I release,
indemnify and hold harmless Happy House, its officers, directors, employees
and affiliates and The Way to Happiness Foundation, its officers, directors,
employees and affiliates from any and all liability if my child is injured in
any way while doing or performing any action connected with the Contest or if
my child causes injury to another or to the property of another while participating
in the Contest.
I represent that I have read the foregoing and fully and completely understand
the contents and are able to grant the rights contained in this Authorization
And Release For Photos And/Or Audio And/Or Video Recording And Release Of Liability.

RELEASE FORM
I (We), the undersigned individual(s), grant ________________________ (Participating
Group) and Happy House, the sponsor of the Street-Wise Challenge Contest, the
perpetual, non -exclusive, royalty-free right and license to:
- Record my participation and appearance on digital or film photography, video
tape, audio tape, or any other medium (collectively, the “Recordings”).
- Use my name (or any fictional name), likeness, voice and biographical material
in connection with these Recordings to be used only in or for submission in
the Street Wise Challenge Contest (Purpose).
- Reproduce, distribute, publicly display and/or publicly perform, in print,
electronic or any other medium, copies of the Recordings, in whole or in part.
Grantor represents that he or she possesses all rights necessary to grant
this permission for and in connection with the Purpose.
This grant of rights is made voluntarily by me. I further agree to release and
forever discharge Participating Group, Happy House, their agents, employees,
and designated representatives, from any and all claims in law or equity that
I, my heirs or personal representatives, have or shall have, arising out of
Recordings.
This release is governed in accordance with the laws of the State of California
